What can be appealed or reviewed?
The Judicial Council can consider the following:
- Appeals arising from the administration of the Kwanlin Dün Citizenship Code or the Kwanlin Dün Election and Referendum Code.
- Application from Citizens to review actions of the Kwanlin Dün First Nation that may result in the violation of rights and freedoms of the Citizens.
- Applications from Citizens challenging certain decisions of the Council.
- Applications from Citizens to review and administrative decision of the Kwanlin Dün First Nation which affects them.
What can the Judicial Council do?
In an appeal, the Judicial Council can:
- Affirm or set aside a decision or action relating to an alleged violation of a Citizen’s rights.
- Affirm or set aside a decision based on the constitutionality of the decision.
- Uphold or dismiss an appeal regarding administration of the Kwanlin Dün Citizenship Code or the Kwanlin Dün Election and Referendum Code.
